Fact Sheet 4 - Export Prohibitions and Restrictions

The following schedule sets out a brief explanation of the export prohibitions and restrictions that the New Zealand Customs Service enforces at the border.

Afghanistan — exports of arms and related materials of all types including weapons, ammunition, military vehicles and equipment, paramilitary equipment and parts for all of these goods to:

(a) Usama bin Laden.

(b) The Taliban.

(c) A Taliban entity.

(d) An Al Qaida entity.

Protected New Zealand objects — e.g.,

(a) Maori artifacts over 50 years old.

(b) Any bones, feathers, or other parts of the Moa or other extinct New Zealand Species.

(c) Other goods over 50 years old which have national, scientific, or artistic importance, e.g., Books; Letters and other documents; Parts of ships and aircraft; Photographs and films; Stamps and coins; Traction engines; Veteran and vintage motor vehicles; Works of art.

CFCs, halons, carbon tetrachloride, methyl chloroform, methyl bromide, HCFCs and HBFCs. To protect the ozone layer. Ministry of Economic Development Ozone Layer Protection Act 1996
Chemical weapons and a range of chemicals that may be used in the manufacture of chemical weapons. To enforce the provisions of the Chemical Weapons Convention. Ministry of Foreign Affairs and Trade Chemical Weapons (Prohibition) Act 1996
Cloned and hybrid human embryos. To prohibit unacceptable human assisted reproductive procedures and research.  Ministry of Health Human Assisted Reproductive Technology Act 2004

Cote d’Ivoire — exports of arms and related materials of all types including weapons, ammunition, military vehicles, and equipment or paramilitary equipment, including spare parts for any such goods. Dairy produce. Only the New Zealand Dairy Board Ltd or an approved exporter may export to:

• Canada — all butter.
• Japan — all prepared edible fats and all cheeses of tariff heading 0406 excluding: cheeses not made from cows milk; mascarpone, ricotta, feta, blue mould cheeses, and white mould cheeses, in each case in immediate packages having a net content not exceeding 12 kilograms; all other cheese in immediate packages having a net content not exceeding 3 kilograms (prepared for immediate consumption, not for further processing).

• the Dominican Republic — all milk powder.

• The EU — butter, cheddar cheese, and cheese for processing to be imported into the EU under New Zealand’s current access quota.

• The USA — all cheddar, low fat, NSPF, and American-type cheeses.

Democratic Republic of the Congo—exports of arms and related materials of all types including weapons, ammunition, military vehicles, and equipment or paramilitary equipment, including spare parts for any such goods. Horticultural products — apricots, avocados, blackcurrants, boysenberries, cherries (sweet), chestnuts, kiwifruit to Australia, nashi pears, nectarines, peaches, persimmons, plums, squash, tamarillos, and truffles. Iran— export of goods that could contribute to Iran’s enrichment-related, or reprocessing, or heavy water-related activities, or to the development of nuclear weapon delivery systems. United Nations Sanctions. Ministry of Foreign Affiars and Trade United Nations Sanctions (Iran) Regulations 2007
Iraq — exports of:
(a) Weapons of all kinds such as arms, ammunition, missiles, military vehicles and equipment, or paramilitary equipment.

(b) Spare parts for the goods listed in paragraph (a); and

(c) Goods that may be used to produce the equipment listed in paragraph (a).

(d) Iraqi cultural property, i.e., items of archaeological, historical, cultural, rare scientific, and religious importance illegally removed from the Iraq National Museum and other locations in Iraq.

Living modified organisms (LMOs). To enforce the provisions of the Cartagena Protocol on Biosafety. Ministry for the Environment Import and Exports (Living Modified Organisms) Prohibition Order 2005
Marine mammals, for example, seals, whales, dolphins and porpoises, and parts of marine mammals. To protect marine mammals. Department of Conservation Marine Mammals Protection Act 1978

Persistent Organic Pollutants (POPs) covered by the Stockholm Convention, e.g., Aldrin, DDT, Dieldrin, Endrin, PCBs. To enforce the provisions of the Stockholm Convention. Ministry for the Environment Imports and Exports (Restrictions) Prohibition Order (No. 2) 2004
Pounamu (greenstone).
This prohibition does not apply to:
• Articles made from pounamu (for example, jewellery, pendants or sculptures containing pounamu).

• Consignments that are being exported by a single exporter and in which the total weight of pounamu does not exceed 5 kilograms.

Sierra Leone — exports of:
(a) Arms and related materials of all types, including weapons, ammunition and military vehicles, military and paramilitary equipment, and spare parts for the above goods.

(b) Petroleum and petroleum products.

Sudan—exports of arms related and materials of all types including weapons, ammunition, military vehicles, and equipment or paramilitary equipment, including spare parts for any such goods. Weapons — certain conventional weapons and dual use (strategic) goods that have or may have military use, such as computers, navigation and marine equipment, firearms, ammunition, military aircraft and vessels; dual use equipment, chemicals, biological agents and plant pathogens, that may be used to manufacture chemical, nuclear and biological weapons.
